Privacy Policy

Introduction

SublityATS is operated by DigitalArchitect com, Inc. ("DigitalArchitect.com," "we," "us," or "our"). This Privacy Policy explains how we collect, use, share and protect information when you use SublityATS. In this policy, "Customer" means an employer, recruiting firm or recruiter that subscribes to SublityATS, and "Candidate" means a person whose information a Customer holds in SublityATS.

We Do Not Sell Personal Information

We do not sell personal information. We share it only as described in this policy, with service providers that process information on our behalf, and where the law requires.

Who Controls Candidate Data

When a Customer uploads or enters Candidate records, DigitalArchitect.com processes that data on the Customer’s behalf and under the Customer’s instructions. The Customer is responsible for having the right to hold those Candidates’ information and to contact them. Candidates who want to access or delete information a Customer holds should contact that Customer directly.

Information We Collect

1. Account Information: When a Customer’s users create accounts, we collect information such as name, email address and phone number.
2. Candidate Information: The Candidate records a Customer uploads, enters or receives through applications.
3. Usage Data: How users interact with SublityATS, including IP addresses, browser types and access times.

How We Use Information

1. Service Provision: To provide and maintain SublityATS for our Customers.
2. Communication: To send Customers administrative messages about their accounts.
3. Improvement: To customize the experience and improve our services.

Marketing to Uploaded Contacts

If a Customer turns on SublityJobs, we send the Candidates that Customer works with an email introducing SublityJobs and inviting them to create a profile. Candidates choose whether to hear from the Customer, how often and how, and can opt out at any time. We send no other marketing about our services to contacts that Customers upload, and a Customer’s candidate list is never shared or sold.

Candidates Who Connect Through SublityJobs

Candidates who have a SublityJobs profile decide, Customer by Customer, whether that Customer receives updates to their profile. This is off until the Candidate turns it on. A Customer receives only what the Candidate chooses to share. Phone numbers and email addresses are never shared this way. A Customer receives them only when a Candidate applies to one of its jobs and chooses to share them. A Customer never automatically receives a Candidate’s documents.

Artificial Intelligence

Artificial intelligence reads resumes to fill in Candidate profiles, suggests roles, helps Customers set up their workflows, and drafts cover letters. It makes no hiring decisions; people at the Customer do. Resumes are processed by a third-party AI model provider.

Data Sharing and Disclosure

1. With the Customer: Candidate information is stored for the Customer that holds it.
2. Service Providers: Companies that process information on our behalf, such as hosting and email delivery.
3. Legal Requirements: We may disclose information to comply with legal obligations, protect our rights, or enforce our Terms.

Data Security

We implement security measures to protect information. However, no system is completely secure, and we cannot guarantee the absolute security of information.

Data Retention and Customer Data After Cancellation

We retain information for as long as necessary to provide our services and for legitimate business purposes. When a Customer cancels, we keep that Customer’s data for 30 days so it can be exported, and then delete it. A Customer can export or request deletion of its data at any time by contacting privacy@digitalarchitect.com.

International Data Transfers

Information may be transferred to, stored, and processed in countries other than your own. We take steps to ensure it is protected according to this Privacy Policy.

Your Rights

1. Access and Correction: Users can access and update their account information through their profile.
2. Communication Preferences: Users can manage their communication preferences and opt out at any time.
3. Deletion: Users can request deletion of their personal information, subject to certain exceptions.

Children

SublityATS is a business tool and is not intended for anyone under 18. We do not knowingly collect information from them. If we learn we have collected such information, we will delete it.

Changes to This Privacy Policy

We will post changes on this page with a new effective date. If we make a material change, we will notify Customers before it takes effect.
